1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and KIIRE EKSAM OÜ ("Company", "we", "us", "KiireArst") governing your use of the KiireArst automated doctor appointment booking service.

By accessing or using the KiireArst service, you agree to comply with these Terms. If you do not agree to the Terms, you must not use the service.

3. Service Description

KiireArst provides an automated doctor appointment booking service that:

  • Monitors the Terviseportaal (Health Portal) system for available doctor appointments
  • Automatically books appointments according to user-defined settings and criteria
  • Operates through the official Terviseportaal authorization mechanism
  • Sends SMS/email notifications after successful appointment bookings

Our service is a tool designed to simplify the booking process and DOES NOT:

  • Provide medical advice, diagnosis or treatment
  • Replace emergency medical services
  • Guarantee appointment availability or accessibility

4. Eligibility and Registration

4.1 Eligibility

To use KiireArst, you must:

  • Have access to healthcare services through Terviseportaal
  • Have a valid Terviseportaal account
  • Provide accurate and up-to-date registration information

4.2 Account Registration

Registration requires:

  • A valid phone number
  • An email address (recommended)
  • An Estonian personal identification code (isikukood)
  • Granting authorization through Terviseportaal

5. Authorization and Access

5.1 Granting Authorization

To use our service, you must grant KiireArst full authorization in Terviseportaal. (Full rights level of authorisation principal)

  • The authorization provides us with technical access to view, modify, and close all of your data, except for medical documents that you have personally restricted, as well as the ability to purchase prescribed medications from pharmacies on your behalf.
  • KiireArst undertakes to process only the minimum amount of data necessary solely for providing the KiireArst service and registering appointments through Terviseportaal.

    • 5.1.1 For the purpose of providing the service, KiireArst uses only the following data:

  • Access to read the user's active referrals.
  • Access to read and modify active appointments strictly within the referral/specialization specified by the user.
  • Access to read, modify, and create new appointments strictly within the referral/specialization specified by the user.
  • Access to read the validity and expiration date of the user's Tervisekassa (Health Insurance Fund) insurance.
  • Access to read the user's first name, last name, and personal identification code (isikukood).

Authorization is granted and managed exclusively through the official Terviseportaal systems in favor of KIIRE EKSAM OÜ.

5.2 Scope of Authorization

Although full authorization technically provides broader access, KiireArst undertakes to use such access only to the extent necessary for providing the service. We will NOT:

  • Use medical records, diagnoses, or medical history beyond what is necessary for providing the service
  • Share your medical information with third parties without legal basis
  • Use access to Terviseportaal for unauthorized purposes

5.3 Revocation of Access

  • You may revoke authorization at any time through Terviseportaal settings
  • Revoking access will immediately disable automated booking functionality
  • After subscription expiration or exhaustion of the booking quota, the system initiates removal of the authorization through Terviseportaal

6. Pricing and Payments

6.1 Pricing Plans

KiireArst offers the following payment options:

  • One-time registration: one appointment booking
  • 5 bookings per 2 month

Current prices are displayed on the website and may change periodically. Price changes do not affect already paid billing periods and apply only to new purchases or future subscription renewals.

6.2 Payment Processing

  • Payments are securely processed through Montonio
  • Available payment methods are displayed by the payment provider
  • All prices include applicable taxes unless stated otherwise
  • Payment confirmation may be sent via email

6.3 Subscription Terms

  • Monthly subscriptions renew automatically unless canceled by the user
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • Unused bookings do not carry over to the next period

7. Service Usage and Restrictions

7.1 Filter Configuration

You are responsible for:

  • Correctly configuring appointment preferences (specialty, location, time, etc.)
  • Selecting only appointments that you are genuinely able and willing to attend
  • Updating filters when your preferences change

7.2 Automatic Booking

  • After configuration, the system may automatically book appointments matching your filters
  • You will receive an SMS/email notification after a successful booking
  • You are responsible for attending, canceling appointments on time, and any possible consequences imposed by healthcare providers

7.3 Service Availability

  • We strive to maintain high service availability but do not guarantee uninterrupted operation
  • We will provide advance notice of maintenance work whenever possible
  • We are not responsible for downtime of Terviseportaal or third-party services

8. Refund and Cancellation Policy

8.1 Right of Withdrawal

Under European Union consumer protection legislation, you have the right to withdraw from the contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the date of purchase.

To exercise the right of withdrawal, you must notify us at [email protected].

8.2 Refund Terms

  • One-time purchases: full refunds are available if booking has not yet been completed
  • Subscriptions: proportional refunds for unused bookings may be available within 14 days
  • After the digital service has begun (for example, after a successful appointment booking), the right to a full refund may be limited in accordance with EU law
  • Refunds are issued to the original payment method

Refunds are usually processed within 14 days after confirmation of the request.

8.3 Subscription Cancellation

  • You may cancel your subscription at any time
  • Access to the service continues until the end of the paid billing period
  • Refunds for partially used billing periods are not provided unless required by law

9. User Responsibilities

You agree to:

  • Provide accurate and truthful information
  • Maintain the security of your account credentials
  • Attend or properly cancel booked appointments
  • Comply with the terms of use of Terviseportaal
  • Not abuse the service or attempt to bypass its limitations
  • Independently pay any applicable healthcare provider fees

You agree NOT to:

  • Share your account with other persons
  • Use the service for fraudulent purposes
  • Attempt to copy or reverse engineer the service technology
  • Book appointments without intending to attend them

10. Medical Disclaimer

IMPORTANT INFORMATION:

  • KiireArst is not a healthcare provider
  • We do not provide medical advice, diagnosis or treatment
  • The service does not replace emergency medical assistance
  • We are not responsible for the quality of healthcare services provided by medical institutions
  • Medical institutions may cancel or modify appointments independently of the service

11. Limitation of Liability

11.1 Service Limitations

To the maximum extent permitted by law:

  • We do not guarantee the availability of appointments or successful bookings
  • We are not responsible for technical issues related to Terviseportaal or third-party services
  • We are not responsible for appointment cancellations by healthcare providers
  • We are not responsible for missed notifications due to reasons beyond our reasonable control

11.2 Liability Cap

Our total liability is limited to the amount paid by you for the service during the previous 12 months.

11.3 Exclusions

We are not liable for:

  • Indirect, incidental or consequential damages
  • Loss of profits, data or business opportunities
  • Consequences resulting from missed appointments

These limitations do not affect your mandatory consumer rights under applicable law.

12. Data Protection and Privacy

Use of the service is governed by our Privacy Policy.

By using the service, you consent to:

  • Collection and processing of personal data in accordance with the Privacy Policy
  • Processing of health-related data necessary for providing the service
  • Use of technically necessary cookies

13. Intellectual Property

All elements of the KiireArst service belong to KIIRE EKSAM OÜ and are protected by intellectual property laws.

You may not:

  • Copy, modify or distribute the service software or content
  • Attempt to reverse engineer the service technology
  • Use trademarks without written permission

14. Termination

14.1 Termination by User

You may terminate your account usage at any time by contacting us.

14.2 Termination by Company

We may restrict or terminate access to the service if:

  • You violate these Terms
  • You provide false information
  • You abuse the service or engage in fraudulent activity
  • Required by law

14.3 Effects of Termination

  • All authorizations are automatically revoked
  • Data is deleted in accordance with the Privacy Policy
  • Refunds for partially used periods are not provided unless required by law

15. Changes to the Terms

We may periodically update these Terms.

Material changes may be communicated in advance via email or SMS.

Continued use of the service constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia.

Disputes shall be resolved in Estonian courts unless otherwise required by mandatory law.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Force Majeure

We are not responsible for delays or inability to provide the service due to circumstances beyond our reasonable control, including Terviseportaal failures, actions of government authorities, communication outages, cyberattacks, natural disasters or other force majeure events.

20. Language of the Terms

These Terms may be available in multiple languages. In the event of discrepancies between versions, the English version shall prevail.
